These Terms of Use (“Terms”) govern your use of ByOwners.com (the “Site”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. What ByOwners.com is — and isn’t

ByOwners.com is an online marketplace and information service that lets owners advertise property and lets interested parties contact them. We are not a real estate broker, agent, dealer, lender, mortgage broker, escrow or title agent, law firm or financial adviser. We do not represent any party, negotiate on anyone’s behalf, hold deposits, verify every statement in a listing, or guarantee any transaction. Information on the Site is general and educational, not legal, tax, financial or real estate advice.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to post a listing or submit a form. You’re responsible for the accuracy of the information you provide.

3. Listing rules

By submitting a listing, you confirm that:

• You own the property or are legally authorized to list it, and you have any licenses your state requires if you list on behalf of others.
• The description, price and photos are accurate and not misleading, and you have the right to use the photos and content you submit.
• The listing complies with all applicable laws, including the federal Fair Housing Act and state and local fair housing laws. Listings may not indicate any preference, limitation or discrimination based on race, color, religion, sex, disability, familial status, national origin, or other protected characteristics.
• You’ll comply with required disclosures (for example, the federal lead-based paint disclosure for most housing built before 1978) and all laws that apply to your sale or rental.
• You’ll tell us when the property is sold, rented or no longer available.

We may edit listings for formatting, clarity or compliance, and we may decline, suspend or remove any listing at our discretion, including if we suspect fraud, inaccuracy or a violation of these Terms. Free listings run for 90 days unless renewed.

4. Prohibited conduct

You agree not to: post false, fraudulent or duplicate listings; impersonate anyone; request payment by wire transfer, gift card or cryptocurrency before an in-person inspection and signed agreement; harvest user information; send spam; upload malware; scrape the Site in a way that burdens it; infringe intellectual property; or use the Site for any unlawful purpose.

5. Messages and dealings between users

Inquiries are relayed between users as a convenience. Any agreement is solely between the parties. You are responsible for verifying identities, ownership, condition, title and funds, and for using licensed professionals where appropriate. Please follow our safety guidance.

6. Paid upgrades and contributions

Optional listing upgrades are invoiced after approval and are non-refundable once the listing is published with the upgrade, except where required by law. Voluntary contributions (“donations”) support the Site’s operations; ByOwners.com is not a charitable organization and contributions are not tax-deductible.

7. Service providers and advertising

Providers in our Pro Network and advertisers are independent businesses. We don’t guarantee their work. Verify licenses and insurance before you hire. Providers pay flat advertising or directory fees and do not pay us based on referrals or closed transactions. The Site displays third-party ads, including Google AdSense; ads are not endorsements.

8. Contests

Contests are governed by the Official Rules posted for each round. No purchase is necessary to enter or win.

9. Your content

You keep ownership of content you submit. You grant ByOwners.com a worldwide, non-exclusive, royalty-free license to host, display, reproduce, format and distribute it in connection with operating and promoting the Site. You’re responsible for your content.

10. Our content and trademarks

The Site’s original content, design, text, graphics, code and compilation are owned by ByOwners.com and protected by copyright and other laws. You may share links and brief quotations with attribution, but may not copy or republish substantial portions without permission. Third-party names and marks belong to their owners; see our Disclaimer & Trademark Notice.

11. Copyright complaints

If you believe content on the Site infringes your copyright, send a notice through our contact page with: identification of the work, the location of the material on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you’re authorized to act, and your physical or electronic signature. We’ll respond and may remove the material.

12. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. Calculator results are estimates based on your inputs. We don’t warrant that listings, guides or tools are accurate, complete or current.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BYOWNERS.COM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY TRANSACTION WITH ANOTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR $100.

14. Indemnity

You agree to indemnify and hold harmless ByOwners.com from claims arising from your content, your listings, your transactions with other users, or your violation of these Terms or the law.

15. Changes and termination

We may update these Terms or change, suspend or discontinue any part of the Site at any time. Continued use after changes means you accept them. We may suspend access for violations.

16. Governing law

These Terms are governed by the laws of the United States and the state in which ByOwners.com’s operator is established, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remains in effect.
